Terms of Service

These Terms govern your access to and use of DM Now, a product operated by Engineering Buddies, including its website, dashboard, automation, AI, commerce and support features. When the signup flow asks you to accept this version, selecting that control and creating the account records your agreement. Storefront purchases and seller publishing may also present transaction-specific terms.

1. Eligibility and accounts

You must be at least 18, legally able to enter these terms, and authorized to act for any organization you represent. Provide accurate information and keep login credentials secure. If you use Google Sign-In, Google provides the verified identity fields needed to create or access the account.

2. The service

DMNow helps creators and businesses automate permitted Instagram interactions, manage contacts, and operate related commerce and workflow features. Features and limits may differ by plan and may change as the service evolves.

3. Connected services

Some features depend on third-party services such as Google, Meta and Instagram, hosting, payment, email, and AI providers. Your use of those services remains subject to their terms and policies. DMNow is not responsible for third-party outages, restrictions, or account decisions.

4. Acceptable use

You may not use DMNow to:

• send spam, deceptive messages, unlawful promotions, or content to people who have not engaged with you;
• harass others, impersonate a person or business, or infringe privacy or intellectual-property rights;
• upload malware, disrupt the service, evade limits, or attempt unauthorized access;
• violate applicable law or the rules of Google, Meta, Instagram, or any connected platform.

You are responsible for the automations, messages, content, products, and offers you create or send through DMNow.

5. Plans, billing, and subscription refunds

Paid access renews at the cadence shown at checkout until canceled from Billing. Indian catalog prices are exclusive of tax; Dodo or Stripe adds applicable tax during checkout. Cancellation stops the next renewal while access continues through the paid period. Except where law or checkout terms require otherwise, a completed purchase is non-refundable once access is activated. This does not limit mandatory consumer rights, and a confirmed refund, lost dispute or chargeback may revoke the associated paid entitlement. When a monthly or annual term ends, the account returns to Free limits; stored account content is not automatically deleted.

6. Storefront sellers and buyers

A seller is responsible for having rights to each product, accurately describing it, complying with law, providing required tax/refund disclosures, fulfilling the purchase, supporting buyers, and avoiding prohibited, deceptive, infringing, unsafe or unlawful material. KYC and payout eligibility may be required. The platform may deduct the fee shown before publication or payout and may delay or reverse payout for refunds, disputes, chargebacks, suspected fraud, legal obligations or negative balances.

DM Now provides the storefront and payment workflow but is not the creator or publisher of a seller’s product. Buyers contract for that product with the identified seller and must review the product description, price, delivery format and seller refund terms before payment. Digital access may be delivered immediately after verified payment, which can affect cancellation rights where applicable. Mandatory consumer rights remain.

7. Your content and data

You retain ownership of your content. You grant DMNow the limited permission needed to host, process, and transmit it solely to provide, secure, and improve the service. Our handling of personal data is described in the Privacy Policy.

8. DM Now intellectual property

DM Now software, branding, designs and documentation are owned by Engineering Buddies or its licensors. These terms give you a limited, revocable, non-transferable right to use the service; they do not transfer ownership.

9. Availability and disclaimers

We work to keep DMNow reliable, but the service is provided on an “as available” basis. We do not guarantee uninterrupted operation, specific engagement or revenue results, or continued availability of a third-party integration. To the extent permitted by law, implied warranties are disclaimed.

10. Limitation of liability

To the extent permitted by law, DMNow will not be liable for indirect, incidental, special, consequential, or punitive damages, lost profits, lost data, or third-party platform actions. Engineering Buddies’ aggregate liability relating to DM Now will not exceed the amount you paid for the service during the six months before the event giving rise to the claim.

11. Suspension and termination

You may stop using DMNow at any time. We may suspend or terminate access when reasonably necessary to protect users or the service, comply with law, respond to third-party platform requirements, or address a material breach of these terms.

12. Changes and governing law

We may update these terms and will post the revised date on this page. Material changes will apply prospectively. These terms are governed by the laws of India, and disputes will be handled by courts of competent jurisdiction in India, subject to any protections that applicable consumer law gives you.
